The power of HOAs. An HOA has the authority to enforce the rules and regulations of the community using the community rules, or “bylaws and covenants.” These rules are considered “agreed upon” since homeowners approve them through board-elected representatives.

The primary purpose is to ensure the maintenance, upkeep and enhancement of the community’s quality of life and the value of the property. They typically operate through rules, regulations and bylaws agreed upon by the homeowners.

The big issue with HOAs is that if you’ve got a problem with them — or they’ve got a problem with you — it can be quite a dilemma. Association rules aren’t just kind little suggestions, they’re enforced through fines and liens and in extreme cases, even foreclosures on people’s properties.

    Try this on for size… the HOA failed to enforce dues collection until the grand total owed exceeded 50k. The lousy HOA took everyone to court to force payment, which would result in them getting a sort of windfall. At court the judge threw the matter out, citing “if the need for the money wasn’t so great over those years of not collecting, then why is it suddenly so huge now? Drug problem? Gambling problem? What?”
