New Zealand: Fight over future of community garden heads to Supreme Court

The fight over a 0.7-hectare piece of Auckland land that houses a community garden is heading to the Supreme Court in the latest round of legal action to determine its future.

Sitting on the former Unitec campus in Mt Albert, Sanctuary Gardens Mahi Whenua was established in 2011 and hosts educational workshops, tours and working bees, among other things, thanks to the efforts of around 60 volunteers.
However, the gardens have been embroiled in a long-running dispute with the Crown since the land it sits on was sold in 2018.
Unitec sold 39.7 hectares to the Crown, with at least 4000 homes set to be built there over the next 10-15 years.
The housing development, led by three r?p? (Marut??hu, Ng?ti Wh?tua, Waiohua-T?maki) and facilitated by the Ministry of Housing and Urban Development (MHUD), is set to include around 500 apartments on the land where the gardens are.
Initial infrastructure has been built; however, further development has been on hold since the Incorporated Society that represents the gardens won a 2025 court case over the status of a caveat granted to the gardens when the land was sold.
