• Trump’s Response: When directly asked by reporters if these actions would be war crimes, Trump refused to answer, instead redefining the term by claiming that Iran’s possession of nuclear weapons or the killing of its own protesters justified U.S. military strikes.Genocide Findings In September 2025 and June 2026, the UN Commission concluded that Israel committed genocide in the Gaza Strip by deliberately targeting Palestinian children, imposing a total siege, and systematically destroying infrastructure.  The Commission found that Israel’s actions met the threshold for genocidal acts under the 1948 Genocide Convention, including killing members of the group and deliberately inflicting conditions of life calculated to bring about physical destruction.  The International Court of Justice (ICJ) has also heard charges regarding these allegations, with provisional measures issued in 2024 ordering Israel to prevent genocidal acts. 

  ICC Arrest Warrants and Legal Charges

  In November 2024, the International Criminal Court (ICC) issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant.  The Pre-Trial Chamber found reasonable grounds to believe they bore criminal responsibility for war crimes and crimes against humanity committed from October 8, 2023, to May 20, 2024.  The specific charges include:

• Starvation as a method of warfare: Systemically restricting food, water, medicine, and fuel to the civilian population. 

• Crimes against humanity: Murder, persecution, and other inhumane acts. 

• War crimes: Intentionally directing attacks against the civilian population and civilian objects, including hospitals. 

• The Court rejected Israel’s challenges to its jurisdiction, asserting that the alleged crimes fell within its mandate. An arrest warrant was also issued for Mohammed Deif, a Hamas military commander, for crimes including extermination, torture, and hostage-taking.

  UN Findings on Genocide

  The UN Independent International Commission of Inquiry has issued escalating reports concluding that Israel has committed genocide in the Gaza Strip. 

• September 2025 Report: The Commission formally concluded that Israel committed genocide, citing “genocidal intent” demonstrated by explicit statements from Israeli officials and a pattern of conduct aimed at destroying Palestinians in Gaza as a group. It identified four genocidal acts: killing members of the group, causing serious bodily/mental harm, inflicting conditions of life calculated to bring about physical destruction, and imposing measures to prevent births. 

• June 2026 Report: A subsequent report focused on the deliberate targeting of Palestinian children, stating that over 20,000 children have been killed and 44,000 injured since October 2023.  The Commission found that even after the October 2025 ceasefire, children continued to be killed and subjected to torture, sexual violence, and starvation.  The report argued that by destroying the health, education, and development of children, Israel is eroding the foundational structure of Palestinian society and its capacity to exist.
