Texas Judge allows X’s lawsuit against Media Matters to move forward

Elon Musk’s social media platform X has secured a small win in its efforts to sue media watchdog Media Matters of America. This was thanks to a federal judge in Texas, who allowed X’s lawsuit to proceed, regardless of Media Matters’ efforts to have the case dismissed. 

In a decision, U.S. District Judge Reed O’Connor in Fort Worth noted that X had sufficiently alleged that the media watchdog had acted with “actual malice” based on statements criticizing the platform, as noted in a Reuters report. Judge O’Connor also rejected Media Matters’ request to dismiss the case on jurisdictional grounds because the media watchdog had targeted blue-chip companies like AT&T and Oracle, which are based in Texas, in its report.

X shared the update in a post from its official @XNews account.

“Yesterday, a federal court denied Media Matters’ motion to dismiss X’s claims that Media Matters falsely disparaged X’s business and tortiously interfered with X’s advertising contracts. Media Matters manipulated its user timeline on X to create the false impression that certain major brands’ ads were appearing next to fringe posts. Media Matters then published an article touting those false claims, which were widely repeated by the legacy media, in an effort to harm X’s advertising business. The court ruled that Media Matters plausibly ‘manipulated and intended to deceive [X’s] advertisers’ and ‘acted with malice,’” X wrote in its post. 

X’s lawsuit against Media Matters was filed last November following a report from the media watchdog claiming that the social media platform was showing pro-Nazi posts and antisemitic or otherwise hateful content next to advertisements from prolific companies. A number of high-profile companies such as Apple, IBM, and Comcast opted to pause their advertisements on X following the media watchdog’s report. 

In its lawsuit, X claimed that Media Matters used deceiving tactics to give the impression that advertisements from major corporations were appearing alongside controversial content. These include exclusively following fringe accounts and large advertisers, then repeatedly refreshing their feed until a paid post from an advertiser is next to a controversial post.

“Media Matters therefore resorted to endlessly scrolling and refreshing its unrepresentative, hand-selected feed, generating between 13 and 15 times more advertisements per hour than viewed by the average X user repeating this inauthentic activity until it finally received pages containing the result it wanted: controversial content next to X’s largest advertisers’ paid posts,” X wrote in its legal complaint.
