In a December 9th letter to Christopher Wray, Sen. Chuck Grassley (R-IA) described a long list of reasons he had lost confidence in the FBI director.
  1. Failure to promptly and thoroughly comply with congressional oversight requests: Director Wray pledged to be responsive to congressional oversight but has consistently failed to provide timely and complete information, hindering Congress’s ability to oversee the FBI.
  2. Failure to provide information on the FBI’s mishandling of sexual harassment claims by female employees: Wray has not provided adequate information on how the FBI handled sexual harassment claims, despite multiple requests and the discovery of credible whistleblower disclosures.
  3. Failure to respond to inquiries about the vetting of Afghan evacuees under Operation Allies Welcome:  The FBI failed to answer inquiries about the vetting of Afghan evacuees, including those flagged as security concerns, which has raised concerns about national security.
  4. Failure to investigate bribery allegations against the Biden family while strictly scrutinizing former President Trump:  The FBI had possession of incriminating information against the Biden family for three years but took no action, while it intensely scrutinized Trump based on less credible sources.
  5. Failure to be transparent about the FBI’s role in pushing the Steele Dossier as part of the 2016 election interference investigation:  Wray has not been forthcoming about the FBI’s use of the Steele Dossier, which was funded by the Clinton campaign and used to obtain FISA warrants against Trump associates.
  6. Failure to treat former President Trump and former Secretary of State Clinton equally regarding mishandling of classified information:  The FBI conducted an unprecedented raid on Trump’s home but did not take similar actions against Clinton, despite both mishandling classified information.
  7. Failure to explain the FBI’s unprecedented raid on Mar-a-Lago in contrast to its inaction on Clinton and Biden:  Wray has not adequately explained why the FBI raided Trump’s home while taking a more lenient approach with Clinton and Biden’s mishandling of classified documents.
  8. Failure to prevent the FBI from being used to undermine the congressional investigation into Biden family corruption:  The FBI provided an unnecessary briefing that Democratic leaders used to label the investigation into the Biden family as Russian disinformation, undermining Congress’s work. 
  9. Failure to be transparent about the FBI’s actions regarding the Richmond memo that tied traditional Catholics to extremism: Wray initially claimed the memo was a single product but later revealed a second external memo. The FBI redacted information about other field offices’ involvement and failed to explain Wray’s misleading testimony.
  10. Failure to protect whistleblowers and respond to requests for information on whistleblower protections:  Despite pledging to protect whistleblowers, Wray has failed to respond to multiple requests for information on safeguards and has not committed to not using taxpayer money for retaliation.
  11. Failure to respond to inquiries about the FBI’s raid of a former whistleblower’s home:  The FBI took nearly two and a half years to provide a paltry response to a request about the raid of a former whistleblower’s home, which did not provide any useful information.
  12. Failure to provide information on potential whistleblower retaliation in the form of security clearance suspensions: Wray has not responded to requests for information on the status of those who lost their security clearances after making protected disclosures to the DOJ’s Office of Inspector General.
  13. Failure to update on the status of criminal referrals related to the Kavanaugh nomination:  The FBI has not provided updates on the status of criminal referrals related to individuals who made false statements during the Kavanaugh nomination process.
  14. Failure to respond to inquiries about the FBI’s targeting of pro-life activist Mark Houck:  The FBI has not adequately addressed concerns about the heavy-handed raid on pro-life activist Mark Houck, despite requests for information on the matter.
  15. Failure to respond to inquiries about the FBI’s support for the defunded Project Thor anti-cartel program:  Wray has not responded to inquiries about the FBI’s support for Project Thor, an ATF anti-cartel program defunded by the Biden DOJ.
  16. Failure to respond about the delay in arresting an individual who threatened Judge Aileen Cannon:  The FBI has not explained the delay in arresting an individual who made violent threats against Judge Aileen Cannon after she dismissed charges against Trump.
  17. Failure to respond to inquiries about whistleblower allegations of State Department obstruction of the FBI:  Wray has not responded to inquiries about allegations that the Obama-Biden State Department obstructed the FBI from making arrests related to Iran’s nuclear and ballistic missile programs.
  18. Failure to keep Grassley updated on the investigation into the attempted assassination of former President Trump:  The FBI has not provided updates on the investigation into the attempted assassination of former President Trump, despite requests for information.
  19. Failure to respond to a criminal referral related to child trafficking at the HHS Office of Refugee Resettlement:  Wray has not responded to a criminal referral related to child trafficking through the Biden-Harris Office of Refugee Resettlement at the Department of Health and Human Services.
  20. Failure to provide transparency on FISA query abuses and protocol violations:  The FBI has not been transparent about FISA query abuses, including the improper searching of politicians’ names and thousands of protocol violations reported by the Foreign Intelligence Surveillance Court.
Grassley summarized the issues succinctly, stating:
As we stand at the threshold of a new Congress and a new administration, with seven years of water under the bridge, you’ve failed in [all of your] fundamental duties as director. Even President Biden, who denied weaponizing his administration against President-elect Trump, has finally admitted that political bias has indeed infected law enforcement. These failures are serious enough and their pattern widespread enough to have shattered my confidence in your leadership

He concludes with an admonition:

Your and Deputy Director Abbate’s failure to take control of the FBI has hindered my work and others’ work throughout multiple Congresses on matters that needed timely information, and has prevented the truth on some issues from ever reaching the American people. You’ve also shown a continuing double standard and failure to carry through on promises. For the good of the country, it’s time for you and your deputy to move on to the next chapter in your lives…

 …I’ve spent my career fighting for transparency, and I’ve always called out those in government who have fought against it. For the public record, I must do so once again now. I therefore must express my vote of no confidence in your continued leadership of the FBI. President-elect Trump has already announced his intention to nominate a candidate to replace you, and the Senate will carefully consider that choice. For my part, I’ve also seen enough, and hope your respective successors will learn from these failures

Wray’s legacy, as far as it tarnishes the annals of American justice, is one of profound disgrace. Whether or not he committed crimes, and at what point in time, remains cloaked in ambiguity. However, what stands stark and undeniable is the devastation he has wrought upon the Bureau’s once-sterling reputation. 
His actions demand more than mere accountability; they necessitate a moment of introspection and, ultimately, an acknowledgment of the ignominy that will forever shadow his name in the history of law enforcement.
My hope is that a new FBI director like Kash Patel will revamp the FBI and provide the American people with the transparency we deserve.
