LOL: Illinois Passes Law Banning Immigration From Arresting Illegals In Certain Areas

Illinois law protects immigrants from arrest near courthouses, hospitals or colleges

Immigrants living in Illinois, among the states hit hardest by the Trump administration’s immigration crackdown, are now shielded from federal enforcement near courthouses, hospitals, university campuses and day cares under a law Democratic Gov. JB Pritzker signed Tuesday.

The law, which takes effect immediately, also provides legal steps for people whose constitutional rights were violated during the federal enforcement action in the Chicago area, including $10,000 in damages for someone unlawfully arrested while attempting to attend a court proceeding.

“Dropping your kid off at day care, going to the doctor, or attending your classes should not be a life-altering task,” Pritzker said at a bill-signing in the largely Latino Little Village neighborhood in Chicago. “Illinois — in the face of cruelty and intimidation — has chosen solidarity and support.”

Coming to the U.S. illegally or overstaying your visa puts you in the position to be detained. It’s on you. Further, just about the only daycare involved was when an illegal was running from federal law enforcement and ran into a daycare. What if the people involved are not illegals: can they be arrested? Quite often places like courthouses are the safest places, because there’s a limited chance they will be armed. What about Americans being arrested in hospitals because they are Bad People? Is that OK?

Anyway, good luck enforcing this law

Critics complain the law will be overturned by the courts.

Oh, I’m sure the Democrats in Democrat run Illinois can find several Democrat federal judges to uphold the the law, but, it will be killed on appeal.

Federal agents are now prohibited from making civil arrests in or around courthouses of a person attending certain legal proceedings, and the law provides for $10,000 in fines for the arrest of someone the officer should have known was attending a court hearing. It prevents the release of private medical records by hospitals, blocks universities from taking certain actions regarding the immigration status of students or employees and precludes day cares from sharing such status information.

Tricia McLaughlin, assistant secretary of the Department of Homeland Security, said of Pritzker, “He must be unfamiliar with the U.S. Constitution,” the Supremacy Clause of which declares that federal law cannot be superseded.

The law pretty much puts state residents in conflict between this state law and federal law. Oh, and federal immigration officers will certainly ignore the law, and good luck to any state or local officer who tries to interfere. Notice, though, it is about “civil” arrests. Why would illegals be in court for civil matters? What if they are in court for assault? Does the Illinois law allow for their arrest?

Regardless, federal law overrides state law when it comes to immigration, as Los Federales were tasked with immigration in the Constitution, and there is no federal law blocking illegal alien arrests in any of those places. Nice try, J.B.
