Judicial Watch Requests Court to Order Fani Willis to Release Communications with Special Counsel Jack Smith, Pelosi’s January 6 Committee

(Washington, DC) – Judicial Watch announced that it has asked a Georgia state court to reject Fulton County District Attorney Fani Willis’ efforts to continue hiding records about her office’s communications with Jack Smith’s office and the January 6 Committee.

Judicial Watch filed a March 2024 open records lawsuit after Willis falsely denied having any responsive records (Judicial Watch Inc. v. Fani Willis et al. (No. 24-CV-002805)).

Judicial Watch argues that 212 pages of still-secret records must now be released, as the controversial criminal case against President Donald Trump and others has been dismissed and Willis’ claims of privilege are without merit.

“Fani Willis can’t hide behind a misreading of Georgia law to keep secret her communications with Jack Smith and the January 6 Committee,” stated Judicial Watch President Tom Fitton. “The ‘pending prosecution’ excuse no longer applies.”

In December 2024, the Superior Court in Fulton County granted a motion for default judgment against Willis in this lawsuit. The court awarded Judicial Watch attorneys’ fees and ordered Willis to search for and provide releasable records to Judicial Watch within five business days.

Subsequently, Willis refused to release any non-public documents in response to the court order that found her in default. Willis’ Open Records Department denied any records about Jack Smith existed and cited a series of legal exemptions to justify the withholding of communications with January 6 Committee. Willis’ office did release one, already public, letter to January 6 Committee Chairman Benny Thompson.

In January 2025, the Superior Court in Fulton County, GA, issued an order granting $21,578 “attorney’s fees and costs” to Judicial Watch.

In February 2025, a hearing was held before Judge Robert C.I. McBurney of the Superior Court of Fulton County, GA, on a motion for in camera (private) “inspection and appointment of special master” to oversee Willis’ search for records of communications in this case.

Willis was ordered to turn over 212 pages of records to a state court judge in March 2025.

In August 2025, Willis was ordered to provide new information and potentially conduct a new search for Trump-related records because her recent affidavit to the court made no reference to whether any searches of the devices of former Fulton County Special Prosecutor Nathan Wade or those of Chief Investigator Michael L. Hill, who was involved gathering evidence and coordinating investigative efforts, and likely met with the January 6 Committee.

In January 2026, Judicial Watch sued the Justice Department for communications of FBI agents regarding the prosecution of former Trump trade advisor Peter Navarro

In August 2025, Judicial Watch sued the Justice Department for communications between former Assistant Special Agent in Charge Timothy Thibault and the anti-Trump organization American Oversight.

In June 2025, Judicial Watch sued the Justice Department for records about the FBI’s Arctic Frost investigation.

In June 2025, Judicial Watch sued Arizona Attorney General Kris Mayes for her communications with Smith.

In March 2025, Judicial Watch sued the Justice Department for details of any investigations, inquiries, or referrals concerning potential misconduct of any person working for Smith.
