Is it Possible to Not Pay Federal Income Taxes Legally?
In this 12 April 2026 published video, host Marjorie Taylor Greene talks with Joseph Banister, a former IRS Criminal Investigation Special Agent known for publicly challenging the legal authority of the federal income tax. He resigned from the IRS in 1999 after his superiors allegedly refused to address his research suggesting that most Americans are not legally required to pay income tax.

In 2005, a federal jury acquitted Banister of all criminal charges, including conspiracy and assisting in the filing of false tax returns. The Bernhoft Law Firm successfully argued that Banister acted with integrity and lacked intent to defraud. Despite his criminal acquittal, the IRS Office of Professional Responsibility disbarred Banister in 2004, prohibiting him from representing clients before the agency. In 2017, the U.S. Ninth Circuit Court of Appeals affirmed thousands of dollars in penalties against Banister for preparing frivolous tax documents for clients.
Banister’s claims, which he maintains through his website and media appearances, includes his argument that the 16th Amendment was never properly ratified. He claims that for most “average Americans” there is no specific statute that makes them liable for income tax, suggesting it is technically voluntary. He views the W-4 as a voluntary agreement rather than a mandatory contract. Federal courts have consistently rejected these “tax protester” arguments as frivolous.
