Agriculture States Propose Legislation To Protect Bayer From Liability For Pesticides

Where in the Constitution for the united States of America or the Constitution for any State is authorization for government to grant immunity to manufacturers for harm caused by their products or use of their products? Before you go combing through the documents, it is nowhere to be found. Why? To grant immunity to manufacturers for harm caused by their products or use of their products is a form of fascism – a joining of private industry and government against the people. But, that hasn’t stopped governments from doing so (federal government with vaccines) or attempting to do so.

In an attempt to further fascism, Iowa and other farm states have drafted a series of proposed laws that would inhibit lawsuits against pesticide manufacturers for “failing to warn users of health risks, provided their product labels are approved by the US Environmental Protection Agency (EPA).

Opponents have labeled Iowa’s version of the measure the “Cancer Gag Act”, pointing to the state’s second-highest cancer rate in the nation and fears of links to widespread pesticide use.

The bills, currently circulating in more than 20 states and introduced in at least eight, are backed by significant advertising campaigns. The push has created divisions within farm advocacy groups, with the Iowa Farmers Union opposing the measures and groups like the Iowa Farm Bureau Federation supporting them.

Aaron Lehman, president of the Iowa Farmers Union, warned, “Our farmers feel that if they have injuries or illnesses due to their use of a pesticide, they should have access to the courts. We just don’t think the playing field should be tilted.”

Supporters argue the legislation is necessary to protect access to essential crop protection products and prevent litigation they claim is not scientifically substantiated. Meanwhile, opponents say the legislation strips farmers and pesticide users of their ability to hold manufacturers accountable for health impacts. [How do supporters of this legislation know the litigation claims are not “scientifically substantiated” – based on the label? Not all ingredients are listed on the label. Pharmaceutical products are a good example of that.]

The efforts are largely driven by Bayer, the Germany-based parent company of the former Monsanto Co., which faces ongoing lawsuits over its Roundup herbicide. Bayer has spent billions on settlements and jury verdicts and is seeking legislative changes to limit such legal challenges. Bayer claims the proposals are essential to safeguard its “important investments” and maintain access to products deemed safe by the EPA, stating that registered pesticides with EPA-approved labels “satisfy requirements for health and safety warnings.” [Emphasis Mine – we’ll come back to Bayer shortly]

CropLife America, a lobbying group representing pesticide manufacturers, also supports the legislation, maintaining that the EPA serves as the expert authority charged with evaluating pesticide safety.

Does anyone remember DDT? It was touted as “safe” with videos on YouTube showing the harmful pesticide being sprayed on the public while eating, being outdoors, etc. In fact, some have indicated that the use of DDT helped fuel polio cases through direct pesticide (toxic) poisoning. DDT was banned from use in all 50 States and the US in 1972 and lifted from the market in 1973. Interestingly enough, the EPA resisted prohibiting DDT. Remember, this is the agency “charged” with protecting the environment and the people from environmental harms, such as pesticides.

Bayer, formed in 1863, in Germany by Friedrich Bayer and Friedrich Weskott, originally established as a dyestuffs producer. It is also known as Bayer AG. It produced the compound acetylsalicylic acid, aka Aspirin, beginning in 1899. In 1925, Bayer merged with five other companies to form IG Farben, making it the largest chemical and pharmaceutical company in the world. The other five companies were: Agfa, BASF, Bayer, Chemische Fabrik Griesheim-Elektron [de], Hoechst, and Weiler-ter-Meer.

In the 1920s, the company had ties to the liberal nationalist German People’s Party and was accused by the Nazis of being an “international capitalist Jewish company”.  A decade later, it was a Nazi Party donor and, after the Nazi takeover of Germany in 1933, a major government contractor, providing significant material for the German war effort. Throughout that decade it purged itself of its Jewish employees; the remainder left in 1938. Described as “the most notorious German industrial concern during the Third Reich“, in the 1940s the company relied on slave labour from concentration camps, including 30,000 from Auschwitz, and was involved in medical experiments on inmates at both Auschwitz and Mauthausen. One of its subsidiaries supplied the poison gas Zyklon B, which killed over one million people in gas chambers during the Holocaust.

At the end of World War II, the Allies seized the company and its directors were put on trial.

Held from 1947 to 1948 as one of the subsequent Nuremberg trials, the IG Farben trial saw 23 IG Farben directors tried for war crimes and 13 convicted. However, by 1951 all of them were released from prison early after the U.S. military instituted good time credits in its war crime program. What remained of IG Farben in the West was split in 1951 into its six constituent companies, then again into three: BASF, Bayer, and Hoechst. ….  Following several later mergers the main successor companies are Agfa, BASF, Bayer and Sanofi.

Sanofi is a French multinational pharmaceutical and healthcare company headquartered in Paris. It merged with Aventis in 2004.

Bayer purchased Monsanto in 2016 and assumed the financial and litigation burden brought about by Monsanto’s weedkiller Roundup. Bayer purchased Monsanto knowing about the litigation and financial burden that would be assumed.

Yes, this information came from Wikipedia, which can be unreliable. However, it is reliable in connecting Bayer to the notorious IG Farben and Bayer’s split from IG Farben becoming a prominent company in the West. This means Bayer was complicit in crimes committed in Nazi Germany.

With what has been discovered during the CONvid-1984 planned scam-demic with the Food and Drug Administration (FDA), Centers for Disease Control (CDC) and other government agencies, why is anyone comfortable claiming the EPA is the “expert authority charged with evaluating pesticide safety”? Didn’t anyone learn anything from the DDT debacle? With this logic, one could say the FDA is the “expert authority charged with evaluating vaccine safety” – Everyone should know how that has been exposed as false. If the EPA operates like the FDA, which one can suppose it does, everyone should be more than skeptical about the EPA being any authority on pesticide safety.

At least one individual recognizes the failings of the EPA.

Jonathan Oppenheimer of the Idaho Conservation League criticized the EPA’s reliance on industry-funded studies and highlighted the need for public oversight.Many dangerous products have been on the market for years because manufacturers limited disclosure of harmful findings,” he said. [Emphasis Mine]

In addition to state-level battles, a coalition of attorneys general from 11 states, including Iowa, Alabama, and South Carolina, has filed a petition with the EPA seeking federal regulatory changes. The proposal would bar any state labeling requirements that differ from EPA findings on a pesticide’s safety, further shielding manufacturers from lawsuits.

Farmers, it’s difficult for sure to feed the nation – no doubt about it. Many Americans do not fully appreciate the difficulties you face in doing so, the hard work it takes, nor the expense and sacrifice. There are no vacations when one farms. But, there are many that do appreciate you and would support your decision to cease using these products produced by a company/companies involved in atrocities committed against a group of people during World War II. Many recognize the harmful nature of products developed by these companies and hidden from the public by government agencies. No company should be shielded from lawsuits if the products they produce cause irreparable harm.

Friends, it is time to mobilize. For those in the States of Nebraska, Iowa, Alabama, Indiana, Arkansas, Georgia, Louisiana, Montana, North Dakota, South Dakota, and South Carolina, it is time to flood the State Attorney Generals’ offices with phone calls, letter, and emails calling out their lawlessness in attempting to shield pesticide manufacturers from lawsuits when their products cause harm to farmers and those using them. Never forget what happened with the National Childhood Vaccine Injury Act of 1986, nor the CONvid-1984 modified mRNA gene therapy bioweapon shot protection from liability. Also, go to the petition site and leave a public comment. The deadline is February 20, 2025.

These State Attorney Generals should be called out and removed from office in the States moving for pesticide manufacturer immunity from lawsuits.

It’s time to cease purchasing products from companies who seek immunity for harms their products cause. The government agencies, unconstitutional as they are, charged with “protection of the people from product harm” have sold their souls to the corporations becoming fascist in nature. For our own health, we should cease using pesticides, period. Not only do pesticides kill harmful insects, they kill beneficial insects as well while causing harm to humans and other animals.

If this legislation passes in these states, how long is it going to take for other states to follow suit? These companies will have less incentive to make safe products, if you can even call pesticides “safe”, if granted liability immunity. These are not only products farmers use. Average Americans use pesticides also throughout the united States, as well as pest control companies.
