The CAD History Nobody Cleared: How Version Trees, PDM Logs, and Export Records Are Turning Design Files Into Federal Trade-Secret Evidence

Every save, check-in, and export inside a modern CAD environment writes a permanent record. Federal prosecutors and civil plaintiffs can subpoena that record and read it back to a jury. It was built for engineering discipline: revision control, regulatory audits, supplier handoffs. It also happens to be a near-perfect timeline of who touched what part, when they touched it, and where the file went next.

When a departing engineer walks out with a design, the courtroom argument is rarely about whether the file moved. The PDM log already answered that. The fight is over what the movement proves.

Trade-secret disputes used to live mostly in civil court, where the standard of proof and the reach of the subpoena were narrower. They now land in federal criminal filings with real regularity, and the digital breadcrumbs a CAD stack leaves behind are often the spine of the government’s case.

The Log You Kept for ISO Is the Log the Government Subpoenas

Data-management systems don’t need to be modified to become evidence. They already record everything a forensic examiner would want.

  • Version trees. Every revision carries a user, a timestamp, and a diff against the prior version. A file that changed hands three times in the week before a resignation is not a subtle pattern.
  • Check-in and check-out records. PDM vaults note who pulled a file, how long they held it, and what state it was in when returned. Bulk activity in the final days of employment stands out immediately.
  • Export and print history. Neutral-format exports (STEP, IGES, Parasolid, PDF) are the usual exfiltration route because they strip proprietary features while preserving geometry. The export itself is logged, even when the destination file is long gone.
  • License and session telemetry. CAD and PLM tools record which workstation opened which file, for how long, and often from what network. That data ties an individual to a specific model at a specific hour.

These logs are not incidental. In regulated industries, PDM audit trails are typically configured to resist tampering and to record every modification alongside the user identity, timestamp, and stated reason. The same properties that make them useful for a quality auditor make them devastating in a courtroom.

The Instinct to Clean Up Is the Move That Sinks the Case

The obvious response, once someone realizes those records exist, is to make them go away. Purge the local cache. Reformat the laptop before returning it. Ask IT to shrink the vault history. Delete the personal Dropbox folder that received the STEP files. Every one of those instincts makes the situation worse, and often turns a civil dispute into a criminal referral.

Forensic examiners do not rely on the primary log alone. USB insertion events sit in the Windows registry. Cloud sync clients leave local databases naming every uploaded file. Email gateways keep envelope metadata even when a message is deleted from the mailbox.

A practitioner walkthrough of employee data-theft investigations catalogs the artifacts that survive routine deletion, and the list is long. Wiping the visible copy leaves the shadow, and the shadow now comes paired with evidence of the wipe.

Two additional exposures follow. Obstruction and spoliation are independent offenses, so a person who was going to face a weak misappropriation claim can end up charged with destruction of evidence instead. And the Economic Espionage Act carries criminal forfeiture of property and proceeds derived from a violation, which reaches equipment, accounts, and downstream revenue. The cleanup expands the target.

Build the Record Before Anyone Asks for It

The better posture assumes the logs will one day be read by a stranger and works backward from there. Treat CAD governance as a legal artifact, not just an engineering convenience.

  • Lock the definition. Mark sensitive assemblies, fixtures, and process documents as confidential inside the PDM itself, with access controls that match the label. A file the company never treated as a secret is hard to later call one.
  • Limit neutral-format exports. Require a workflow approval for STEP, IGES, and PDF exports of controlled parts, and log the business reason.
  • Watch the exit window. Elevated CAD activity in the two weeks before and after a resignation is a common pattern in these cases. Automated alerts on bulk check-outs and off-hours exports pay for themselves.
  • Preserve, don’t purge. Once litigation or an investigation is foreseeable, a legal hold freezes logs, mailboxes, and endpoints. Anyone who touches those systems after the hold needs to be told, in writing, not to delete anything.
  • Get counsel in early. Whether the concern is a departing employee or a subpoena about a hire, a federal defense attorney who has handled trade-secret matters can shape what happens next before positions harden. The first 72 hours usually decide whether the case stays civil or turns criminal.

The Version Tree Was Built to Testify

CAD teams built version control to answer engineering questions: which revision shipped, who approved the change, why the fillet grew by a millimeter in week nine. Those same answers, produced under subpoena, tell a jury a story about intent. The person best positioned in that story is the one who assumed all along that the record would be read out loud, and behaved accordingly.
