Justice and accountability

A friend and correspondent recently shared several views of how both appointed judges (federal and State) and grand juries have constantly favored some politicians and political opinions and parties over others. She pointed out correctly that the two concepts are linked. Nothing else is possible.

It is important to note that the Lord has warned us multiple times in the Bible about wicked judges and perverted justice. Even many who identify as atheists and reject the Bible as the Word of God the Creator recognize the wisdom found in both the Old and New Testaments. Judaism and Christianity are not the only religious systems that recognize the need for moral actions. And the deadly nature of immoral actions, especially on the part of those who have any kind of authority in society.

This is not just a few judges, but the entire system of law enforcement. It is not just judges that are corrupt, but the system to select juries (including grand juries) that is corrupted. Until the judges and the legislators are truly held accountable, the corruption will grow worse. Immorality contaminates all parts of society and every action. It rots society. It may take decades or even centuries, but ultimately the effects are irreversible.

We realize this is not a universally accepted truth. And that corruption and immorality are part of the very foundation of human government. But history demonstrates the truth. And points out what could be solutions, applicable even if mandatory human government is finally rejected.

A man or woman who is incapable of upholding their marriage vows is virtually certain to be unable to live up to their affirmation or oath to perform their duties, respect and obey the Constitution and laws, and administer justice (and mercy). Regardless of their political affiliation, seeming commitment to honesty and fairness, and claims of service.

That is just one example.

A legislator who gains immoral (if not explicitly illegal) wealth cannot be trusted with any decision, not just on financial matters. but on anything. A judge, attorney, or legislator (and for that matter, any bureaucrat) who places loyalty to their political party equal to or above their responsibility to follow the law and carry out their duties cannot be trusted with administering the law and performing those duties. Even by human standards.

But our news is filled daily with reports of such corruption. Not just judges who fail to deliver justice to victims of criminals. Nor whom fail to punish wrongdoers but instead order little more than the proverbial slap on the wrist. We also see judges who twist law to unjustly punish people who are of the wrong political persuasion or wrong color or wrong name who do not commit the crimes of which they are accused.

We see and hear of juries, selected through bizarre rituals apparently designed to seat bodies which slavishly obey the instructions issued by the judges and other lawyers, rather than stand up for what is right, what is moral.

John Adams, long ago, somewhat understood this: “Our Constitution was made only for a moral and religious people. It is wholly inadequate to the government of any other.” Adams believed that without a sound moral foundation, the mechanism of government cannot uphold liberty and justice.

But he was mistaken that any human, mandatory government was adequate. (And we include any version of “theocratic” government claiming to be “acting for God.” Consider ancient Egypt, the Roman Catholic Church, and Deseret as warnings we must heed.)

And even voluntary associations and organizations in society can ensure liberty, justice, honesty and peace if those who lead are not corrupt.

Think on these things.
