There are estimated only between about 16,000 to 22,000 true rent-controlled apartments remaining in New York City. This represents a tiny fraction of the city’s housing stock. However, there are approximately 1 million separate rent-stabilized apartments—which cover roughly 43 percent of the city’s total rental market.
True rent control in NYC typically only applies to apartments built before 1947 where the tenant (or their lawful successor) has lived continuously since July 1, 1971. When these units become vacant, they usually transition to the broader rent stabilization program.
To qualify as rent-controlled, a tenant (or their lawful successor) must have continuously lived in the apartment since before July 1, 1971. Because eligibility is tied to this strict timeline, these apartments decrease in number every time a tenant vacates. When a rent-controlled apartment is vacated, it typically converts into a rent-stabilized unit (if the building has 6 or more units) or becomes fully unregulated entirely (if the building has 5 or fewer units).
